“OK Google”. Size matters when it comes to patents

There has been a recent seismic shift in the US patent litigation scene, starting with Sonos ‘winning’ against Google. Please note it is about 6 years since their partnership ended and Sonos accused Google of running off with their IP to develop their own brand of speaker. 
 
Big Tech has been found out for doing this kind of thing many times over the last 20 years, gambling that the pockets of the small co are just not large enough to endure the many rounds of IP court battles required to claim victory.​

Whilst many would observe that Sonos has not really won, because their business suffered immeasurably over the years; there are other things afoot in the US market that seem to favour the smaller inventor. Namely making it more difficult for big co to invalidate the patents of the smaller co using the Patent Trial and Appeal Board (PTAB).
 
Many feel that the balance of power still needs to shift further to support smaller inventive businesses, because it is still too easy for big tech to ‘lawyer up’ and crush the smaller competitor.
 
Strong IP protections are essential to most developed economies. Nearly 30% of all jobs in the United States are in IP-intensive industries, from film to software to biotechnology.
 
Anyway let’s celebrate the Sonos good news: it succeeded in achieving an import ban into the US for all Google speakers using their patented technology.
