Registered company yes, but not the right to trade under the name?

The year 2020 to 2021, saw the highest ever number of UK company incorporations, there were 810,316 company incorporations, almost a 22% increase yoy. 
In some cases there will be very similar registrations to your business name and this is worth keeping an eye on. 

There is a belief that registering a business name at Companies House (UK) provides the rights to trade under that name, however a Company House registration alone, may not provide sufficient rights. 

Registering a company name does not automatically protect it by trade mark law, nor enable you to trade under that name - there may be unregistered trade mark rights preventing you. Similarly, if you register a trade mark, you may not necessarily be able to register it as a limited company name!

Choosing a trading name for a business, product or service is not as simple as coming up with a great name. Similarly if you are trading under a name it pays to be vigilant and ready to pounce if someone else starts to use your name and infringes your rights: customers, suppliers and creditors can be confused and even your credit rating might be affected. 
It is definitely worth the time thinking this through in advance (‘Premeditatio Malorum’)
